【禁闻】村官换届被操控 选举成过场

【新唐人2011年4月21日讯】广东和山东正在�行村委换届，而中国各地也相继爆出了
所谓"中国特色"的选举，比如过程中，有的几分钟搞定――走形式；有的被官方操控结
果；有的贿选。更令人惊奇的是，民间欢迎的当选干部被黑社会追杀。专家指出，由于
法律和执政者不保护选举的公正性，农村选举只是假民主的过场。

大陆农村选举问题多多，山东先是暴出山东牟平农村最牛选举――五分钟搞定，后又暴出
高票当选的山东省荣成市东山村村委会主任毕重江，在家中被歹徒疯狂砍杀二十多刀。
有村民说，毕重江是东山村上访维权的骨干。

而广东顺德最近也�行了村委会选举投票，其中几个村的维权力量没能胜出，而由政府
和党委推选的候选人上任。村民表示不满。村民维权代表认为，政府在基层选举中有明
显的偏向，排斥民选代表参选，以及在程序上做手脚。现在各村庄的维权力量联手，要
�行抵抗。选举专家姚立法认为，现在的农村村委会选举有很大问题，一是「没有法律
规范」，也就是，政府组织选举的机构，如果侵犯或剥夺农民的选举权和被选举权
时，没有法律条文约束。另一个问题是，选举被少数人或黑社会操控，暗箱操作，致使
选举缺乏公正、透明，更没有任何监督。

姚立法（前湖北潜江市人大代表）："选举的话，就是它不按程序来，正因为它不按程
序来，更缺乏公正、透明，因为他暗箱操作！暗箱操作你怎么监督？它不是在选民面
前，在大庭广众下这样�行的选举。目前中国的选举非常糟糕，只有形式、只有过
场，没有实质，我们的农民成了假民主的装饰品。"

去年底的「乐清案」，为民维权的钱云会付出了生命代价。对于受欢迎的民选代表当选
后不断受到打压、追杀的现实，姚立法表示，老百姓拥护的人当选了村干部，这直接触
犯了当地黑社会和利益团体的利益，他们就疯狂报复、打压，就是想否定选举的结果。

姚立法："为什么出现这种情况？就是法律不保障选举的公正，而且社会特别是执政当
局，它不保障选举的公正----一个是法律上的问题，一个是基层执政的当局，他们不保
护公正，甚至它们成了邪恶势力的保护伞，当然才出现这种情况。"

姚立法从1987年开始，先后四次自我推荐参选湖北潜江市人大代表，最终当选，当选人
大代表后，姚立法自费印刷《谁当村官村民说了算》等小册子免费派发给农民，并组织
农民学习《选举法》和自荐人大代表的细节等。

2004年9月，姚立法接受美国国务院邀请，观摩美国总统大选。他的传奇故事与他在任
时揭露的冤案，和当局非法操作选举等事件，被改写成《我反对：一个人大代表的参政
传奇》一书。

姚立法认为，基层选出的「非公正民选」代表，再参与更高层的选举，同样失去了公正
合法的基础。因此他说："中国没有实实在在的选举，只有假民主的形式、假民主的过
场。"

China's Pseudo Village Elections

Village elections with Chinese characteristicsare taking place at present
in many parts of China.Some elections took only 5 minutes, otherswere
controlled by authorities, and some were evenbought with money. More
surprisinglypeople's favorite officials are being hunted downby the
underworld. Because law and authoritiesare not interested in maintaining
elections' fairness,village elections are only a pseudo democracy.

Village elections in China have many problems;the most absurd election in
Shandongtook 5 minutes to complete the process.In another village, the
winner was stabbedmore than 20 times at home. Some saidthat he was the
backbone of human rights.

In Guangdong, several villages' rights candidatedid not win, and the
authority-backed candidatestook offices. From the base level, local
authoritiesare biased against people's representativesand they manipulate
the process.Now many villages want to join forces to protest.

Election expert Yao Lifa believes that in rural areas,serious problems
exist. One is "No Laws,"or ifs official organizations deprive citizens of
theirvoting rights, there is no law to restrain them.

Another problem is that the elections are controlledby a few people or the
underworld. As a result,elections lack fairness, transparency and
supervision.

Yao Lifa (ex-member of Hubei People's Congress):"When an election does not
follow the procedure,it will not be fair and transparent.How do you monitor
a secret operation?It does not act before the voters or the public
eye.Current elections in China are terrible;they have formalities and go
through stepsbut have no substance. Our farmersare just window dressings
for pseudo democracy."

In last year's "Yue Qing incident," he gave his lifefor right activist Qian
Yunhui. As for the popularcandidates, after being elected they sufferfrom
suppression and life threatenings. Yao saidthat when popular candidates
become officials,this interferes with interests of the underworld,thus,
revenge and suppression are on their wayto deny the outcomes of the
elections.

Yao Lifa (ex-member of Hubei People's Congress):"Why is this happening?
That is when the law,especially the ruling authorities, do not guaranteethe
impartiality of an election - fist it questionsthe law, and second it is
about the low levelauthorities, they do not want to guarantee fairness.When
they fail to protect the just,they become the umbrella of the evil forces."

Since 1987 Yao was four times self-recommendedcandidate as a member of
Hubei People's Congress,and ultimately elected. He educated farmers withhis
pamphlets: "Villagers have the final say whothe officials should be."
Meanwhile he alsoorganized farmers to learn the election lawand how to
become a self-recommendedmember of the People's Congress.

On September 2004 Yao Lifa accepted an invitationfrom the U.S. State
Department to observe a U.S.presidential election. His legends and the
injusticehe exposed with illegal dealings in China's electionswere all
being written in his book "I Oppose:A Legend of A Member of People's
Congress."

Yao thinks the representatives who are electedby unfair means from a low
level also losetheir legitimacy for the next elections.Therefore, there is
no real elections in China,only pseudo democracy in various forms and
shapes.
